WikiLeaks’ New Release: The Kissinger Cables and Bradley Manning April 12, 2013

WikiLeaks has released a new trove of documents, more than 1.7 million U.S. State Department cables dating from 1973-1976, which they have dubbed “The Kissinger Cables,” after Henry Kissinger, who in those years served as secretary of state and assistant to thepresident for national security affairs

One cable includes a transcribed conversation where Kissinger displays remarkable candor: “Before the Freedom of Information Act, I used to say at meetings, ‘The illegal we do immediately; the unconstitutional takes a little longer.’ [laughter] But since the Freedom of Information Act, I’m afraid to say things like that.”
While the illegal and the unconstitutional may be a laughing matter for Kissinger, who turns 90 next month, it is deadly serious for Pvt. Bradley Manning. After close to three years in prison, at least eight months of which in conditions described by U.N. special rapporteur on torture Juan Ernesto Mendez as “cruel, inhuman and degrading,” Manning recently addressed the court at Fort Meade: “I believed that if the general public, especially the American public, had access to the information … this could spark a domestic debate on the role of the military and our foreign policy in general, as well as it related to Iraq and Afghanistan.”
These words of Manning’s were released anonymously, in the form of an audio recording made clandestinely, that we broadcast on the “Democracy Now!” news hour. This was Bradley Manning, in his own voice, in his own words, explaining his actions.
He testified about the helicopter gunship video that he released to WikiLeaks, which was later made public under the title “Collateral Murder.” In stark, grainy black-and-white, it shows the gunship kill 12 men in Baghdad on July 12, 2007, with audio of the helicopter crew mocking the victims, celebrating the senseless murder of the people below, two of whom were employees of the Reuters news agency.
Manning said: “The most alarming aspect of the video to me, however, was the seemingly delightful bloodlust the aerial weapons team. They dehumanized the individuals they were engaging and seemed to not value human life by referring to them as ‘dead bastards,’ and congratulating each other on the ability to kill in large numbers.”
Reuters had sought the video through a Freedom of Information request, but had been denied. So Manning delivered the video, along with hundreds of thousands of other classified electronic documents, through the anonymous, secure online submission procedure developed by WikiLeaks. Manning made the largest leak of classified documents in U.S. history, and changed the world.
The WikiLeaks team gathered at a rented house in Reykjavik, Iceland, to prepare the video for public release. Among those working was Birgitta Jonsdottir, a member of the Icelandic parliament. She told me: “When I saw the video in February 2010, I was profoundly moved. I was moved to tears, like many people that watch it. But at the same time, I understood its significance and how it might be able to change our world and make it better.”
Jonsdottir co-founded the Icelandic Pirate Party, a genuine political party springing up in many, mostly European countries. A lifelong activist, she calls herself a “pixel pirate.”
The “Collateral Murder” video created a firestorm of press attention when it was first released. One of the soldiers on the ground was Ethan McCord, who rushed to the scene of the slaughter and helped save two children who had been injured in the attack. He suffers from post-traumatic stress disorder. He recently penned a letter of support for Bradley Manning, writing: “The video released by WikiLeaks belongs in the public record. Covering up this incident is a matter deserving of criminal inquiry. Whoever revealed it is an American hero in my book.”
In the three years since “Collateral Murder” was released in April 2010, WikiLeaks has come under tremendous pressure. Manning faces life in prison or possibly even the death penalty. WikiLeaks founder Julian Assange spent a year and a half under house arrest in Britain, until he sought refuge in the Ecuadorean Embassy in London, where he has remained since June 2012, fighting extradition to Sweden. He fears Sweden could then extradite him to the United States, where a secret grand jury may have already issued a sealed indictment against him. Private details from Jonsdottir’s Twitter and four other online accounts have been handed over to U.S. authorities.
WikiLeaks’ latest release, which includes documents already declassified but very difficult to search and obtain, is a testament to the ongoing need for WikiLeaks and similar groups. The revealed documents have sparked controversies around the world, even though they relate to the 1970s. If we had a uniform standard of justice, Nobel laureate Henry Kissinger would be the one on trial, and Bradley Manning would win the Nobel Peace Prize.

JUAN GONZÁLEZ: An historic trial that began Tuesday in Argentina is set to reveal new details about how six Latin American countries coordinated with each other in the 1970s and 1980s to eliminate political dissidents. The campaign, known as Operation Condor, involved military dictatorships in Argentina, Bolivia, Brazil, Chile, Paraguay, Peru and Uruguay. They worked together to track down, kidnap and kill people they labeled as terrorists: leftist activists, labor organizers, students, priests, journalists, guerrilla fighters and their families.
The campaign was launched by the Chilean dictator Augusto Pinochet, and evidence shows the CIA and former Secretary of State Henry Kissinger were complicit from its outset. At least 25 military generals are facing charges, and more than 500 witnesses are expected to testify during the trial. Last August, an Argentine federal judge issued a formal request to the Obama administration’s Justice Department to make Kissinger himself available for questioning. The Obama administration did not respond.
AMY GOODMAN: This trial is taking place in Buenos Aires, the site of a former auto mechanic shop turned torture camp. Argentina is where the greatest number of killings of foreigners was carried out under Operation Condor. All of this comes just weeks after Uruguay’s Supreme Court struck down a law that had allowed similar prosecutions in that country.
Well, for more, we’re joined by John Dinges, author of The Condor Years: How Pinochet and His Allies Brought Terrorism to Three Continents. The book brings together interviews and declassified intelligence records to reconstruct the once-secret events. Before that, Dinges was with NPR and worked as a freelance reporter in Latin America. He is currently a professor at the Columbia School of Journalism.
John Dinges, welcome to Democracy Now!
JOHN DINGES: Yeah, nice to be here. Thanks.
AMY GOODMAN: Talk about the significance of this trial that’s now underway in Argentina.
JOHN DINGES: Well, there have been several trials, and this goes back to when Pinochet was arrested in London in 1998. That unleashed an avalanche of evidence that went across Europe and led to trials in many places—Rome, Paris, Argentina, Chile—but all of them much smaller than this one. This one has 25 people accused. Unfortunately—or fortunately, who knows?—many of the people who were involved in this have already died, they’re getting old, of the top leaders. But this is 25 Argentinians and one Uruguayan, all of whom were in military positions, all of whom were involved directly with the actions of Operation Condor.
This is historic in the sense that we’re going to hear from 500 witnesses. And really, in the Latin American legal system, it’s unusual. It’s really only coming to the fore now that you hear witnesses, as opposed to just seeing them give their testimony to judges in a closed room, and then later on people like me might go and read those testimonies, but really it doesn’t become public. This is all public. And apparently, a lot of it is being videotaped. So this is—this is the first time that the general public is going to hear the details of this horrible, horrible list of atrocities that killed so many people.
JUAN GONZÁLEZ: And, John, for folks who have never heard of Operation Condor or know little about it, the origins of it, how it began, and the nations or the governments that spearheaded it, could you talk about that?
JOHN DINGES: Well, it is a Chilean invention. Augusto Pinochet had dominated his opposition by—the coup was in 1973; by 1974, there was no internal opposition to speak of. But many of the people who had been part of the previous government, that he had overthrown, had gone overseas. There was a very major, important general who was living in Argentina. Political leaders, for example, Orlando Letelier, the former foreign minister and former ambassador to the United States, somebody who would have lunch with Henry Kissinger, was living in Washington. People were spread around, in Europe and all over Latin America, and Pinochet wanted to go after them. And so he mounted Operation Condor.
And he convinced the other countries—Brazil, Uruguay, Argentina, Bolivia and Paraguay—to go along with him, with the argument that there are these guerrilla operations that are a threat to all of them. And there was indeed a guerrilla operation, called the Revolutionary Coordinating Junta, of people who were taking up arms against these governments. And the idea was that they would cooperate in tracking these people down. And they did.
Most of the—the biggest part of the exiles were in Argentina, because Argentina was the last country to give up its civilian government. It wasn’t a dictatorship until March of 1976. And this was created in late 1975. So they were all geared up. And when the coup happened in Argentina, they began killing hundreds of people, of these foreigners. And it’s interesting that you mentioned the Automotores Orletti. This is that auto repair shop that was used as a torture center, and that’s where they kept the international prisoners.
AMY GOODMAN: We, Democracy Now!, went there, visited this shop. I want to read from a declassified record of a CIA briefing that shows that American officials were aware that Latin intelligence services were casting their net wide in Operation Condor. It says, quote, “They are joining forces to eradicate ‘subversion’ … a word which increasingly translates into nonviolent dissent from the left and center left.”
It goes on to another document that you obtained, John Dinges, that’s from the Chilean secret police, known as the DINA. It details the number of dead and disappeared compiled by Argentine intelligence. The cable, sent by DINA’s attaché to Buenos Aires, says he’s, quote, “sending a list of all the dead,” which included the official and unofficial death toll. Between 1975 and mid-’78, he reported, quote, “they count 22,000 between the dead and the disappeared.” Talk about the the number of the dead and what the U.S. knew.
JOHN DINGES: Well, let’s do the U.S. first. The United States, in this period, the 1970s, was a major sponsor of the military dictatorships that had overthrown some democracies, some faltering civilian governments. Whatever it was, the result was governments, like Videla, like Pinochet, like Banzer in Bolivia, who were killing their citizens with impunity. The United States knew about the mass killing. We had this kind of schizophrenic, Machiavellian attitude toward it. We really don’t want these communists to be taking over governments, and we fear that democracy is leading to communist governments. Indeed, a leftist government led by Salvador Allende installed a democratically elected, civilian and revolutionary government in Chile, and that’s why—and Pinochet overthrew that government. The United States was deathly fearful that this would spread in Latin America, and so supported the coming of dictatorships.
When they began mass killings, the United States was aware of these mass killings. When they—they learned of Condor shortly after it was created. There’s no evidence that they knew about it the day it was created. The earliest evidence is a couple months after it began its operations. But they certainly knew these things were happening. And if you look at the meetings, the transcripts of the meetings between Henry Kissinger and these leaders, both in Argentina and in Chile, where we have the records, what do they say in private? You know, “We support what you are doing. We understand that you have to assert your authority. Try your best to release some prisoners, because I’m under a lot of pressure in Congress, because the Democrats are trying to make me, you know, defend human rights. Do the best you can, but I understand what you’re doing.”
And in one case, two weeks after Kissinger visited Santiago, there was a—the second major meeting of all the Condor countries to discuss Condor. And at that meeting, in June 1976, they approved operations for assassination outside of Latin America. The first assassination that occurred was in Washington, D.C. Orlando Letelier, the former foreign minister, was killed on the streets of Washington.
AMY GOODMAN: This is an astounding story. You wrote a book about it, in fact.
JOHN DINGES: And this is—I’ve written actually two books, one about the assassination, in which I, for the first time, wrote a chapter on the discovery of Operation Condor. I didn’t have a lot of detail. In fact, I was misled by the State Department, to a certain extent.
And then, years later, after Pinochet was arrested in London, a flood of documents, including many, many—60,000 pages of documents released by—ordered released by President Clinton, I was able to then, you know, really dig in and understand it from the point of view of the United States. But also, many, many documents were revealed in Latin America. And that is, I think, even more important, because if we just had U.S. documents, it’s always subject to: “Well, that’s the U.S. view of these things.” What was really going on in those Latin American governments—
AMY GOODMAN: But explain how Ron—how Orlando Letelier and his assistant, Ronni Moffitt, were killed in the streets of Washington, D.C., in the United States, in 1976.
JOHN DINGES: Pinochet began this operation shortly after that meeting with Kissinger. Within a month, he gave the order approving this. They sent an agent who had been working for DINA for several years named Michael Townley, an American. I don’t believe it was any accident that they made an American working for them the hit man on this, because, obviously, as soon as suspicion was cast on them, they said, “Oh, this guy was working for the CIA.” And a lot of people like to believe the CIA does all these things. In fact, both the extreme right and the extreme left were saying, “Oh, it was the CIA who did it.” There’s no evidence that Townley was working for the CIA, but he certainly was working for the Chileans.
He allied with some Cubans up in New Jersey, anti-Castro Cubans. They came down to Washington. They—Townley crawled under the car, installed a bomb that he had constructed himself. It was run by one of those old beeper devices. They followed the car down Massachusetts Avenue, and at Sheridan Circle, right outside near the Chilean embassy, they pushed the button, killed him. Ronni Moffitt was the wife of Michael Moffitt, who was actually Orlando’s assistant. She was sitting in the front seat, and that’s why she was killed. Michael survived, and Orlando of course was devastated, died immediately.
AMY GOODMAN: And Townley went to jail for a few years. And then—
JOHN DINGES: Townley—the Chileans turned him over. The story of how we solved this case is incredible. The presumption was that the United States is not going to investigate this very strongly. Everybody that thought that was wrong. The FBI did—made an enormous investigation, solved the case, got pictures of the people. And that’s the long story that I tell in the book. When they identified the people that had come up to the United States to carry this out, they went down to Chile, asked for the cooperation of the Pinochet government. And Pinochet eventually—they had two choices: Either they were going to kill Townley—and there’s evidence that that was one of their plans—or they had to turn him over. And they eventually turned him over. He was taken to the United States, and he began to give testimony. And another flood of information came from Michael Townley. Townley still lives in the United States. He served only five years in prison.
AMY GOODMAN: And then went into witness protection.
JOHN DINGES: And was in witness protection for a while. I understand he’s not anymore in witness protection. He lives in the Midwest. And he’s—he has cooperated. I don’t know whether there’s any remorse on his part, but he has cooperated with many investigations since his imprisonment.
JUAN GONZÁLEZ: John, I’d like to ask you about an unusual figure that you talk about in the book and his role in trying to end Operation Condor: Ed Koch, the recently deceased mayor of New York, who was then a young liberal congressman and who began asking all kinds of questions about what was going on and angered our own government. Could you talk about that?
JOHN DINGES: Ed Koch, a beloved figure in this city, and certainly everybody that’s dealt with him has had the same experience. And I was reporting this story. He was very cooperative with me. And he came to my book party, so I love him, too.
Ed Koch was a congressman. He spearheaded a bill, an amendment to a bill, to cut off military aid to Uruguay. The Uruguayans were members—this was 1976. The Uruguayans were members of Operation Condor. And the CIA discovered—and I think the evidence is that they discovered because they were—they talked about it in front of them, that they said they were going to get the Chileans to go up to Washington to kill Koch. And whether that actually was put into action, we don’t know. But George Bush, who was head of the CIA at the time, called up Ed Koch and said, “Ed” — and it’s wonderful to hear Ed Koch tell this story — ”I’ve got to tell you something: There’s a plot to kill you.” And Ed Koch said, “Are you going to provide me protection?” They said, “No, no, no. That’s not our job. We’re the CIA. We’re just telling you, and it’s up to you to provide your own protection.” Ed Koch didn’t know this was Operation Condor. He just thought this was some crazy people from the dictatorship.
Later on, in my investigation, I was—I actually talked to one of the people who was involved in this, one of the Uruguayans, and who—it was a Condor operation. It was kind of a typical one, even though it didn’t actually kill anybody, luckily. But it was the modus operandi. In order to cover their tracks, one country would use another country’s nationals to do their dirty work in the operations that were planned outside of Latin America. Inside of Latin America, you had a much more systematic and effective way of operating, in which they would just track down each other’s dissidents in whatever country they happened to be—Peru, Brazil, Uruguay, mainly in Argentina. And then they would—the methodology was simple: capture them, kidnap them, torture them, kill them, make their bodies disappear. Very few victims have survived Operation Condor, almost none. It’s very difficult to find a survivor.
JUAN GONZÁLEZ: And yet, today in Latin America, many of the leaders of the new populist governments were folks who had emerged from some of the very groups that Condor was tracking. And Uruguay especially, a former Tupamaro. And throughout the region, those dissidents now are part of the governing apparatus of their countries.
JOHN DINGES: I was in Bolivia just two weeks ago, and I interviewed one of the—one of the people in the Ministry of Communications, and a man who’s among the many, many, many indigenous people who are in the Morales government. And he described how his father had been a prisoner, had been in Chile as an exile. When the military coup happened, he was imprisoned and kept prisoner for seven months and tortured. And I talked to, in that same office, another person who also had been involved in the Bolivian resistance in the 1980s, going back with the group that had fought together with Che Guevara in the 1960s. His father had been involved with them.
These are revolutionaries, but they are a different brand of revolutionaries. They are as dedicated, I think, but they’re not taking up arms. I really believe that they realize that that did not lead to successful revolutions, and so I’m much more optimistic about what’s going on with the—with this current group of governments.
AMY GOODMAN: Finally, a State Department cable, 1978, begins—the jacket of your book, says, “Kissinger explained his opinion [that] the Government of Argentina had done an outstanding job in wiping out terrorist forces.” The significance of the judge calling for Kissinger’s testimony and the Obama administration not responding?
JOHN DINGES: They have asked for Kissinger to give testimony many times. And in my book, I quote the one time where he actually responded to a petition from France, I believe it was. And he basically denied everything. This is very frustrating. I was able to—it was clear to me that, there’s no other word for it, these were lies. I mean, the documents say one thing; Kissinger said another thing. And he knew what those documents said. It’s not—the United States has never allowed any of its officials to face trial in other countries. We are not a member of the ICC. There’s never—
AMY GOODMAN: The International Criminal Court.
JOHN DINGES: The International Criminal Court. There’s never been any participate—there’s never been any trials that have brought Americans in the dock. There was an attempt in Italy; of course, all of those people were gone. The United States, for one reason or another, Democrats and Republicans, protect our own human rights criminals when it’s involving human rights crimes outside of the United States. It’s just the way it is.
AMY GOODMAN: Would you describe Henry Kissinger in that way, as a human rights criminal?
JOHN DINGES: Yes, absolutely.
JUAN GONZÁLEZ: And the relevance of this history of farming out the battle against terrorism, and so you could have no finger marks—no fingerprints of your own involvement to the current war against terrorism in the United States?
JOHN DINGES: Well, I wrote—I was writing chapter one, when 9/11 happened, in my house in Washington. And as I finished the book—and I actually end with a reference to 9/11—I said this is not something that we’re condemned to repeat. And I was making the comparison between the war on terror in the 1970s and the current war on terror that was launched by President Bush. I thought we were going to—we had learned the lesson, that you don’t imitate the methods of your enemies and—or those who had been shown to be human rights criminals. Unfortunately, we crossed that line, I think, many times.
The current discussion about drones, I think, is very frightening, because I’m having a hard time distinguishing between what they did with Operation Condor, low-tech, and what a drone does, because a drone is basically going into somebody else’s country, even with the permission of that country—of course, that’s what Operation Condor did, in most cases: You track somebody down, and you kill them. Now, the justification is: “Well, they were a criminal. They were a combatant.” Well, that may or may not be true, but nobody is determining that except the person that’s pulling the trigger.
I just think that this has to be something that we discuss. And maybe trials like this, going back to the ’70s, people say, “Well, that was the dictatorships of the 1970s.” But the tendency of a state to feel that they can move against their enemies in the most effective way possible is still there, and it is certainly not limited to dictatorships.

Albert Woodfox’s 40 Years of Solitary Confinement February 28, 2013

Albert Woodfox has been in solitary confinement for 40 years, most of that time locked up in the notorious maximum-security Louisiana State Penitentiary known as “Angola.” This week, after his lawyers spent six years arguing that racial bias tainted the grand-jury selection in Woodfox’s prosecution, federal Judge James Brady, presiding in the U.S. District Court for the Middle District of Louisiana, agreed. “Accordingly, Woodfox’s habeas relief is GRANTED,” ordered Brady, compelling the state of Louisiana to release Woodfox. This is the third time his conviction has been overturned. Nevertheless, Woodfox remains imprisoned. Those close to the case expect the state of Louisiana, under the direction of Attorney General James “Buddy” Caldwell, to appeal again, as the state has successfully done in the past, seeking to keep Woodfox in solitary confinement, in conditions that Amnesty International says “can only be described as cruel, inhuman and degrading.”
Woodfox is one of the “Angola 3.” Angola, the sprawling prison complex with 5,000 inmates and 1,800 employees, is in rural Louisiana on the site of a former slave plantation. It gets its name from the country of origin of many of those slaves. It still exists as a forced-labor camp, with prisoners toiling in fields of cotton and sugar cane, watched over by shotgun-wielding guards on horseback. Woodfox and fellow inmate Herman Wallace were in Angola for lesser crimes when implicated in the prison murder of a guard in 1972. Woodfox and Wallace founded the Angola chapter of the Black Panther Party in 1971, and were engaged in organizing against segregation, inhumane working conditions and the systemic rape and sexual slavery inflicted on many imprisoned in Louisiana’s Angola.
“Herman and Albert and other folks recognized the violation of human rights in prison, and they were trying to achieve a better prison and living conditions,” Robert King told me last year. “And as a result of that, they were targeted.” King is the third member of the Angola 3, and the only one among them to have finally won his freedom, in 2001.
King went on: “There is no rationale why they should be held in solitary confinement—or, for that matter, in prison. This is a double whammy. We are dealing with a double whammy here. We are not just focusing on Herman’s and Albert’s civil- or human-rights violation, but there is question also as to whether or not they committed this crime. All the evidence has been undermined in this case.” Since his release, King has been fighting for justice for Wallace and Woodfox, traveling around the U.S. and to 20 countries, as well as addressing the European Parliament.
The devastating psychological impacts of long-term solitary confinement are well-documented. Solitary also limits access to exercise, creating a cascade of health complications. The Center for Constitutional Rights is challenging the use of solitary confinement in California prisons, writing: “Ever since solitary confinement came into existence, it has been used as a tool of repression. While it is justified by corrections officials as necessary to protect prisoners and guards from violent superpredators, all too often it is imposed on individuals, particularly prisoners of color, who threaten prison administrations in an altogether different way.”
In a recorded phone conversation from Angola, Herman Wallace explained: “Where we stay, we’re usually in the cell for 23 hours, and an hour out. I’m not ‘out.’ I may come out of the hole here, but I’m still locked up on that unit. I’m locked up. I can’t get around that. Anywhere I go, I have to be in chains. Chains have become a part of my existence. And that’s one of the things that people have to fully understand. But understanding it is one thing, but experiencing it is quite another.”Despite the decades in solitary confinement, Woodfox remains strong. As he said over a prison pay phone in one of the documentaries about the case, “In the Land of the Free”: “If a cause is just noble enough, you can carry the weight of the world on your shoulders. And I thought that my cause, then and now, was noble. So therefore, they could never break me. They might bend me a little bit, they might cause me a lot of pain. They might even take my life. But they will never be able to break me.”

launching the modern-day civil-rights movement. Monday, Feb. 4, is the 100th anniversary of her birth. After she died at the age of 92 in 2005, much of the media described her as a tired seamstress, no troublemaker. But the media got it wrong. Rosa Parks was a first-class troublemaker.
Professor Jeanne Theoharis debunks the myth of the quiet seamstress in her new book “The Rebellious Life of Mrs. Rosa Parks.” Theoharis told me, “This is the story of a life history of activism, a life history that she would put it, as being ‘rebellious,’ that starts decades before her famous bus stand and ends decades after.”
She was born in Tuskegee, Ala., and raised to believe that she had a right to be respected, and to demand that respect. Jim Crow laws were entrenched then, and segregation was violently enforced. In Pine Level, where she lived, white children got a bus ride to school, while African-American children walked. Rosa Parks recalled: “But to me, that was a way of life; we had no choice but to accept what was the custom. The bus was among the first ways I realized there was a black world and a white world.”
In her late teens, Rosa met Raymond Parks, and they married. Rosa described Raymond Parks as the first activist she had ever met. He was a member of the local Montgomery NAACP chapter, and, when she learned that women were welcome at the meetings, she attended. She was elected the chapter’s secretary.
It was there that Rosa met and worked with E.D. Nixon, a radical labor organizer. Rosa Parks was able to attend the Highlander Folk School in Tennessee, in 1955. The school was a gathering place for activists—black and white together—committed to overcoming segregation, and for developing strategies and tactics for nonviolent resistance to it. It was there that Pete Seeger and others wrote the song “We Shall Overcome” as the enduring anthem of the civil-rights movement.
When she met Nelson Mandela after his release from prison, he told her, “You sustained me while I was in prison all those years.”
When Rosa Parks died, she was the first African-American woman to lie in state in the Capitol rotunda. I raced down to Washington, D.C., to cover her memorial service. I met a young college student and asked her why she was there standing outside with so many hundreds of people listening to the service on loudspeakers. She said proudly, “I emailed my professors and said I won’t be in class today; I’m going to get an education.”
Rosa Parks has much to teach us. In fact, she and other young women had refused to give up their seats on the bus before Dec. 1, 1955. You never know when that magic moment will come. This Feb. 4, the U.S. Postal Service will release a Rosa Parks Forever stamp, a reminder of the enduring mark she made. Rosa Parks was no tired seamstress. As she said of that brave action she took, “The only tired I was, was tired of giving in.”

We begin today with new scrutiny Republican candidate Mitt Romney is facing about his record at the private equity firm Bain Capital. The latest controversy surrounding Bain concerns how Romney helped found the company with investments from Central American elites linked to death squads in El Salvador. After initially struggling to find investors, Romney traveled to Miami in 1983 to win pledges of $9 million, 40% of Bain’s start up money. Some investors had extensive ties to the death squads responsible for the vast majority of the tens of thousands of deaths in El Salvador beginning during the 1980′s. The investors include the Salaverria family, whose former U.S. Ambassador to El Salvador, Robert White, has previously accused of directly funding the Salvadorian paramilitaries. In his memoir, former Bain executive Harry Strachan writes, “Romney pushed aside his own misgivings about the investors to accept their backing.” Strachan writes, “These Latin American friends have loyally rolled over investments in succeeding funds, actively participated in Bain Capital’s May investor meetings and are still today one of the largest investor groups in Bain Capital.” For more, we’re joined by Ryan Grim, Bureau Chief for The Huffington Post . He’s connecting the dots in the latest story headlined, “Mitt Romney Started Bain Capital With Money From Families Tied To Death Squads”. Ryan, welcome to Democracy Now! If you could carefully laid out the story, and set the stage in El Salvador in the early 1980′s, what was happening there, the carnage.
RYAN GRIM: Sure. In 1980, there was land reform instituted by the El Salvadoran government that started to parcel up some of the farms, some of the coffee plantations, and the other land holdings of the elite, and they also nationalized the international coffee trade, so they did not nationalize the industry, but just the foreign export of it. So, the oligarchs responded with a vicious and a brutal campaign that included death squads and in the first year or two, killed something like 35,000 people. Over a decade, killed about 70,000 people. The U.N. has since calculated about 85% of the killing was done by these right-wing death squads, so this is not one of those dirty wars where both sides were equally culpable. The leader of this movement, Roberto D’Aubuisson was very public about his support of death squads and that death squads were an important part of what they were doing. He would actually say that the purpose of the death squads was ultimately to diminish violence, because if you could go into a village and go into a couple houses and kill everyone in there, then it would send a message to the rest of the village that they shouldn’t join the village, and therefore there would be less of an uprising and the death squads would not have to kill everyone. That was the kind of macabre logic that lasted for slightly more than a decade in El Salvador.
AMY GOODMAN: One of the most well known victims of the death squads of the military of El Salvador is Archbishop Oscar Romero, known as the voice of the voiceless. He was a prominent advocate for the poor, a leading critic of U.S.-backed Salvadoran military government. He was killed by members of a U.S.-backed death squad while delivering mass at a hospital chapel. I want to play an excerpt from the film “Romero,” which stars Raúl Juliá who played Archbishop Romero.
RAUL JULIA: I would like to make an appeal in a special way to the men in the Army. Brothers, each one of you is one of us. We are the same people. The farmers and peasants that you kill are your own brothers and sisters. When you hear the words of a man telling you to kill, think, instead, in the words of God, thou shalt not kill. No soldier is obliged to obey an order contrary to the law of God. In his name, and in the name of our tormented people who have suffered so much and whose limits cry out to heaven, I implore you, I beg you, I order you, stop the repression.
AMY GOODMAN: That’s a clip from the film “Romero” of Raúl Juliá who played Salvadoran Oscar Romero. Oscar Romero was gunned down March 24, 1980. Ryan Grim, talk about how he died and the connection to your story.
RYAN GRIM: He was assassinated the day after the clip you played, shot through the heart while delivering mass. We since know, conclusively, that his assassination was ordered by Roberto D’Aubuisson. D’Aubuisson, 18 months later would found the ARENA party which was, basically, at the time, a vehicle for these death squads. ARENA is still around. It has become more of a conventional Latin American right-wing party, but for its first several years, it was, quite simply, the political organization which was managing the death squads. So, Mitt Romney, in this context, knew very well what was happening in El Salvador. The U.S. Ambassador [Robert] White, who you mentioned —
AMY GOODMAN: Robert White.
RYAN GRIM: Robert White, had publicly accused six Salvadorans living in Miami of financing, two of them Salaverrias. When it was suggested to him by Harry Strachan that he go down to Miami to raise money from the exiles there, he actually said to Strachan, make sure that these people are not connected to right-wing death squads. It’s very clear he knew the context and he knew what was going on at the time, but he was having a seriously hard time raising capital for his new enterprise, Bain Capital, and his boss, Bill Bain, told him that he couldn’t use any of the investors or clients of Bain and Co., which was the very successful consulting firm, because if Bain Capital failed, he didn’t want it to take everything else down with it. It’s been reported in a number of places that he failed to raise capital from traditional sources in the U.S. So, given that, he flew to Miami and, in mid 1984, he went directly to a bank and met with a number of these families who were involved with death squads and accepted, what at the time, was a huge amount of money that amounted to 40% of the outside capital that he was able to raise for that initial fund. As Harry Strachan said, they continued to roll over their investments and certainly are worth tens of millions of dollars in Bain Capital now. Just reading from your piece, Ryan Grim, when Romney returned to Miami in 2007 to launch another venture that needed funding, his first presidential campaign, Romney said, “I owe a great deal to Americans of Latin American descent… When I was starting my business, I came to Miami to find partners that would believe in me and that would finance my enterprise. My partners were Ricardo Poma, Miguel Dueñas, Pancho Soler, Frank Kardonski, and Diego Ribadeneira.” Can you talk about these men, like Poma, and their relationship to the death squads in El Salvador?
RYAN GRIM: The Poma family was one of the top families in El Salvador. They were very tightly intertwined with ARENA. The Salaverrias, which we mentioned earlier, two of them were specifically named by White as specifically financing death squads. The De Solas are another family that originally invested in Bain. We know that at least four members of the De Sola family invested in Bain. We only know the names of two of them. There’s one man named Orlando de Sola who the Romney campaign, and nobody else, denies, was a leader of the death squad movement. There’s no question about that. What the Romney campaign has relied on is that they say that Orlando de Solo was a black sheep of the De Sola family. The fact that he was running death squads should not besmirch the four De Sola investors, even though they won’t tell us who two of those four were. However, what we found was that one of the two named De Sola investors — his name is Francisco de Sola — was connected in 1990 to the assassination of two left-wing activists.
There was a meeting held in Guatemala that Chris Dodd, the former senator from Connecticut, moderated. He was trying to strike a peace deal between ARENA and the FMLN. And shortly after that meeting two of the activists who had met with him were assassinated. The Guatemalan government, citing its intelligence sources, concluded that the assassinations were committed by Orlando de Sola, Roberto D’Aubuisson and Fransicso de Sola. Now, Francisco de Sola is still alive and his assistant confirmed to us that he was one of those three people who was accused of these murders. Now, he denied it at the time and denies it today, but just the fact that the Guatemalan intelligence services would lump him together with Orlando de Sola and Roberto D’Abuisson, just known as the basically two leaders of the death squad movement at the time, dramatically undermines the notion that the people involved with Bain are somehow deeply disconnected or that there’s some bright line between the people involved in Bain and the people who are funding and operating the death squads.
AMY GOODMAN: Ryan Grim, Mitt Romney’s response to your investigation and to these allegations?
RYAN GRIM: What they did is they sent me a paragraph of an article from the Salt Lake Tribune in 1999 that read, “As was Bain’s policy, they had the families checked out as diligently as possible. They uncovered no unsavory links to drugs or other criminal activity.” That is simply impossible to believe. These families were certainly connected to death squads. Now Romney told the Boston Globe in 1994, something along the lines of, we checked out the individual investors and made sure there were no “obvious signs of criminal activity,” we didn’t check out their in-laws and their cousins. Those are two inconsistent levels of diligence that Romney is claiming to two separate papers. But, if you take the one at the Tribune, which was sent to me by the Romney campaign, that’s simply unbelievable. There’s no possible way that anybody in 1984 could check out these families — which is the term they use, these families — and come away convinced that this money was clean.
AMY GOODMAN: You quote Robert White saying, “The Salaverria family was very well known.” Robert White was the U.S. Ambassador to El Salvador. “The Salaverria family was very well known as backers of D’Abussion these guys big money contributors, they were total backers of D’Abuisson including death squads.” And I wanted to read an excerpt from Greg Grandin’s book, “Empire’s Workshop.” He is a professor of Latin American history at New York University. He writes, “The problem was that the military groups had very little popular support due in large part to the fact that they were ‘preternaturally violent.’ According to Reagan’s own ambassador, Robert White, their solution to the crisis ‘was apocalyptic: the country must be ‘destroyed totally, the economy must be wrecked, unemployment must be massive,’ and a ‘cleansing’ of some ’3 or 4 or 500,000 people’ must be carried out,” he says. And he his quoting Robert White. Ryan Grim?
RYAN GRIM: I spoke also with the Sergio Bendixen who is a pollster who did a lot of work in the country in the 1980′s for Univision and is now, coincidentally, he became a pollster for Hillary Clinton and he’s now working with the Obama campaign now. He knew D’Abuisson and he knew lot of the people who were involved with these death squads, and he said that, and this is what I have heard from other people who are familiar with him in the exile community, that this is not something they would hide. Like you said, they were persuaded that they were freedom fighters, that they were on the side of justice, and that if it meant that you had to kill tens of thousands or hundreds of thousands of people, those were evil people who were supported by Castro who wanted to bring about tyranny, etc., etc. So, everything that they were doing was justified by that. Mitt Romney even hinted at that in his 2007 talk to the Miami crowd when he came down to raise money for his campaign. He said, not only did these people invest in me, but they taught me a lot. And what they taught me is that these guerrillas were horrible and they kidnapped one of their brothers and killed him and they tortured Miguel Dueñas he mentions. They kidnapped and tortured Miguel Dueñas. There’s no question that atrocities were certainly committed by both sides, but you can see in that quote that Romney is partly buying into this notion that the violence was justified. And he would not be at all be alone in the Republican Party at that time or the Democratic Party. As you said, these death squads had the backing of the United States government.
AMY GOODMAN: We are talking about, as you said, tens of thousands of people in 1989, the government bestowed the Salvadoran government, bestowed — well, this was in 2009. But, remembering, 20 years ago, the killing of the six Jesuit priests in 1989, and then there was the killing of the four American nuns, all these part of the casualties of, as you said, the Salvadoran military and paramilitary, overwhelmingly doing the killing. Now, interestingly, we started with Oscar Romero’s death March 24, 1980. Killed by the right-wing death squads in Salvador. President Obama visited Honduras visited El Salvador and went to the grave of Archbishop Oscar Romero.
RYAN GRIM: And that was an acknowledgment that what the United States and its allies in El Salvador did in the 1980′s was wrong. It wasn’t exactly, but it was tantamount to an apology for all of the death and destruction that was brought about in the name of anti-communism. Archbishop Romero is now known as one of the great heroes and martyrs of the 20th-century. At the same time that we’re talking about Romney’s Association here, we ought to mention that the current occupant of the White House has — operates drones that kill people on a fairly regular basis. There is, unfortunately, still no shortage of killing around the globe.
AMY GOODMAN: And, interestingly, the question, will the Obama administration will make something of this initial Bain investment capital, and will the Romney administration — will the Romney campaign raise the issue of President Obama and his kill list and the operating of drones that are killing many in Yemen and Pakistan, etc.
RYAN GRIM: It will be interesting to see. If the Obama campaign does do anything with it, I would expect that it would be done in the Latino community to help drive support for Obama there, because as you said, there are thousands and thousands and thousands and thousands of refugees who are here today because of the violence from there, and when they find out that the oligarchs that were funding that violence get also helped get Romney’s Bain Capital off the ground, that could influence the way they vote.
AMY GOODMAN: Are these families still donating to Romney’s current presidential campaign as they did to his first effort?
RYAN GRIM: I didn’t find any of them doing so. Romney had a strange use of the phrase we he went to Latin America; he called them Americans of Latin American descent. I don’t know if they have become Americans in the sense of the United States as America. If they haven’t gotten U.S. citizenship, then they can’t donate directly to U.S. presidential campaigns. I searched a few names that we do know, and they did not come up as donors to his presidential campaign. But, as Harry Strachan said, they have become — they continue to be significant investors in Bain Capital. Throughout the 1980′s and 1990′s, Bain Capital made just absolutely extraordinary returns, something like 88% annual return over two decades, which is just an absolutely astounding amount of money. If you apply that to $9 million initial investment, you get an absolute fortune.

Commemorations are being held across the country this year to mark the 100th anniversary of the birth of one of the country’s greatest songwriters, Woody Guthrie. Born on July 14, 1912, in Okemah, Oklahoma, Guthrie wrote hundreds of folk songs, including “This Land Is Your Land,” “Pastures of Plenty,” “Pretty Boy Floyd,” “Do Re Mi” and “The Ranger’s Command.” While Guthrie is best remembered as a musician, he also had a deeply political side. At the height of McCarthyism, Guthrie spoke out for labor and civil rights and against fascism. In this one-hour special, you will hear interviews and music from folk singer Pete Seeger, the British musician Billy Bragg, and the historian Will Kaufman, author of the new book, “Woody Guthrie, American Radical.”
“Woody’s original songs, the songs that he wrote back in the 1930s … with these images of people losing their houses to the banks, of gamblers on the stock markets making millions, when ordinary working people can’t afford to make ends meet, and of people dying for want of proper free healthcare, you know, this song could have been written anytime in the last five years, really, in the United States of America,” says Bragg, who has long been inspired by Guthrie.
Guthrie’s most famous song, “This Land Is Your Land,” was written in 1940 in response to Kate Smith’s “God Bless America.” “Woody saw ['God Bless America'] as a strident, jingoistic, complacent, tub-thumping anthem to American greatness,” Kaufman says. “And now, he had just come from the Dust Bowl. He’d just come from the barbed-wire gates of California’s Eden there. He’d seen the Hoovervilles. He’d seen the bread lines. He’d seen labor activists getting their heads busted. And so, he’s thinking, what — God bless — what America, you know, is Kate Smith singing of?” In 2009, Pete Seeger and Bruce Springsteen performed “This Land Is Your Land” for the inauguration of President Obama.

Amy Goodman: A rare 1945 video recording of Woody Guthrie. Known as the Dust Bowl Troubadour, Guthrie became a major influence on countless musicians, including Bob Dylan, Bruce Springsteen, Pete Seeger and Phil Ochs. While Woody Guthrie is best remembered as a musician, he also had a deeply political side. At the height of McCarthyism, Guthrie spoke out for labor and civil rights and against fascism. He died in 1967 after a long battle with Huntington’s disease. But his music lives on.
Over the next hour, we’ll hear from folk singer Pete Seeger, the British musician Billy Bragg and the historian Will Kaufman. But first, Woody Guthrie, in his own words, being interviewed by the musicologist Alan Lomax
Alan Lomax: What did your family do? What kind of people were they, and where did they come from?
Woody Guthrie: Well, they come in there from Texas in the early day. My dad got to Oklahoma right after statehood. He was the first clerk of the county court in Okemah, Oklahoma, after statehood, as he is known as one of them old, hard-hitting, fist-fighting Democrats, you know, that run for office down there, and they used to miscount the votes all the time. So every time that my dad went to town, it was common the first question that I ask him when he come riding in on a horse that evening, I’d say, “Well, how many fights did you have today?” And then he’d take me up on his knee, and he’d proceed to tell me who he is fighting and why and all about it. “Put her there, boy. We’ll show these fascists what a couple hillbillies can do.”
Alan Lomax: Where did you live? On a farm?
Woody Guthrie: Well, no, I was born there in that little town. My dad built a six-room house. Cost him about $7,000 or $8,000. And the day after he got the house built, it burned down.
Alan Lomax: What kind of a place was Okemah? How big was it, when you remember it, when you were a kid?
Woody Guthrie: Well, in them days, it was a little town, about 1,500, and then 2,000. A few years later, it got up to about 5,000. They struck some pretty rich oil pools all around there—Grayson City and Slick City and Cromwell and Seminole and Bowlegs and Sand Springs and Springhill. And all up and down the whole country there, they got oil. Got some pretty nice old fields ’round Okemah there.
Alan Lomax: Did any of the oil come in your family?
Woody Guthrie: No, no, we got the grease.

We turn now to Will Kaufman, author of the new book, Woody Guthrie, American Radical. Kaufman is a professor of American literature and culture at the University of Central Lancashire, England. He’s also a musician who’s performed hundreds of musical presentations on Woody Guthrie. I interviewed Will Kaufman recently and asked him to talk about Woody Guthrie’s childhood.
Will Kaufman: Well, he was born in Okemah, Oklahoma, as you said, in 1912. He was born to a middle-class, fairly right-wing family. His father, Charlie Guthrie, was a small-town politician, a real estate agent and Klan supporter, supporter of the Ku Klux Klan.
Amy Goodman: Some said he was a Klansman.
Will Kaufman: Yeah, there’s no documentary evidence to firmly establish that Charlie Guthrie was a member of the Klan, but there’s no doubt that he supported them. There’s some anecdotal evidence that he sometimes rode out with them on their adventures and may have participated in a lynching. That affected Woody years later. But there’s no indication that Woody was particularly all that political when he was growing up in Okemah. And then after a number of family tragedies, like the burning down of their house, the death of his older sister in a house fire, the near-fatal burning of his father in a third fire, and the incarceration of his mother in the Oklahoma state mental asylum—she wasn’t crazy; she had the misunderstood and undiagnosed Huntington’s disease—where after all these tragedies, Woody went to join his father in another boom-to-bust oil town in the Texas Panhandle, a place called Pampa, Texas. He dropped out of high school after two years, became a sign painter, married, had his first two children, and then sat there and watched as the Dust Bowl hit the center of the United States, and, you know, tens of thousands of square miles of destroyed farmland just wiped out. Woody was there. And he began to write about the dust.
Woody Guthrie: [singing] Back in Nineteen Twenty-Seven,
I had a little farm and I called that heaven.
Well, the prices up and the rain come down,
And I hauled my crops all into town —
I got the money, bought clothes and groceries,
Fed the kids, and raised a family.
Rain quit and the wind got high,
And the black ol’ dust storm filled the sky.
And I swapped my farm for a Ford machine,
And I poured it full of this gas-i-line —
And I started, rockin’ an’ a-rollin’,
Over the mountains, out towards the old Peach Bowl.
Will Kaufman: Some of those Dust Bowl ballads come out of, really, his late teens and early twenties, you know. Then he joined about half-a-million other migrants heading westwards towards California, where they had heard there was lots of work out there—and, of course, they were wrong. And it’s there in California when Woody gets—he sort of hooks up with the right people, I suppose, and gets involved in the Popular Front out there in California, and this is the beginning of—really, of his politicization. As you said, began writing columns for the People’s World out there and—in Los Angeles, and got a show on a progressive radio station, KFVD, out in Los Angeles, and begins to circulate around the migrant camps, where the Okies, as they were pejoratively called, were living in old dwellings of tar, paper and tin and old packing crates and the bodies of abandoned cars, under railroad bridges, by the side of rivers and what have you, and getting their heads broken when they dared to organize into unions. And Woody began to witness that and began to write about it. And so, he began to see music as a political weapon then.
Amy Goodman: Will Kaufman, talk about 1937, the turning point for Woody Guthrie as he takes on racial issues in this country.
Will Kaufman: Yeah, he—he arrived in California, I think, with the influence of having grown up in a state dominated by the Klan and growing up in a family that supported the Klan. He wasn’t all that racially enlightened when he went out to California. There’s evidence in the Archives that he would, you know, write these mock poems about Africans—African Americans are bathing on the beach in Santa Monica with the—you know, giving off the Ethiopian smell and with jungle rhythms pounding in their veins. And he’d happily sing songs using the N-word and words like “coons” and stuff like that, which were part of that white mountain tradition. And so, he’s on this radio station sometime in 1937, and he announces that he’s going to play a song from Uncle Dave Macon on the Grand Ole Opry, and Gid Tanner and the Skillet Lickers, as well, recorded it, a lovely song called “Run, Nigger, Run.” And he announces it, and he plays it.
And he gets a letter from a member of his listening audience the next day. And I know that letter by heart. I’ve seen it. He says, “You were getting along pretty well on your program tonight, until you announced your nigger blues. I’m a Negro, a young Negro in college. And I certainly resented your remark. No person or person of any intelligence uses that word over the radio today.” And that letter really hit Woody like a slap in the face. He was mortified. He apologized profusely on the air the next day. He made a big point of dramatically tearing out the song sheet from his notebook and tearing it to shreds and promising he would never use that word again. And as he later said, “I apologize to the Negro people for the frothings that I let slip out of the corners of my mouth.” So this is the beginning of his conversion, I suppose, to eventually becoming one of the most ardent champions and activists for racial equality.
Amy Goodman: You mentioned the lynching that occurred a year before he was born that his father—
Will Kaufman: Yeah.
Amy Goodman: —may well have been involved with.
Will Kaufman: Yeah.
Amy Goodman: Talk about how it came back.
Will Kaufman: Well, there was—about a year before Woody’s birth, there was a policeman in Okemah named George Loney, who went to the house of a fellow named Nelson, going to arrest him. I think the charge was sheep stealing or something minor like that. And I don’t think Nelson was there. But certainly his wife Laura and his 12-year-old son Lawrence and a little baby, they were there. And this policeman was apparently very violent, very threatening. And young Lawrence thought that his mother was in danger, and he grabbed a rifle, shot this policeman in the leg. Policeman bled to death on their front lawn.
Lynch mob—well, first of all, Laura and Lawrence and the baby are brought to the jail near Okemah. And then, about a week later, a lynch mob breaks into the jail, drags them to the Canadian River railroad bridge just outside of Okemah. Laura was lynched. Lawrence, 15-year-old—13- to 15-year-old boy, was lynched, after being sexually humiliated in public. And the baby is left crying by the side of the road. And the citizens of Okemah were so pleased with their handiwork that soon they were selling postcards to commemorate it. And Woody saw that postcard, and he actually wrote a song about that. If you want to hear it, I can do it. He never recorded it. It’s called “Don’t Kill My Baby and My Son.”

Amy Goodman: Will Kaufman, author of Woody Guthrie, American Radical. How do you know that melody and that song if Woody Guthrie never recorded it?
Will Kaufman: Yeah, I’ve seen the words. Woody really didn’t—he didn’t write any music. He only wrote lyrics, effectively. I mean, he may—I think he wrote one mandolin tune called “Woody’s Rag” or something like that. But effectively, what he would do is, for the most part, he would write lyrics down, and sometimes he would actually say, you know, “to be sung to the tune of ‘Streets of Laredo’” or something, and he would have a folk song in his head or even a song that, like, a friend of his like Leadbelly wrote. He didn’t really care. You know, he’d steal—he’d steal music, you know, right and left, and admit it. So, for that one in particular, for instance, you could tell—if you know the American traditional, you know, folk repertoire, you could tell sometimes what kind of—what song he had as a pattern in his head. And I could tell by reading the lyrics that he had the old tune “Wild Bill Jones” in his head, so I just put it to “Wild Bill Jones.”
Amy Goodman: In 1940, Woody Guthrie moves to New York.
Will Kaufman: Right.
Amy Goodman: Why?
Will Kaufman: He moves to New York because he has been involved in the labor struggles in the Californian fields, in Kern County, in particular, Madera County—Kern County mostly. And, well, there were quite a few defeats in the Californian fields at that point, and he befriended Will Geer, who people may know. Later on, he was the actor who played Grandpa Walton in The Waltons. Well, he was a very good friend of Woody Guthrie and John Steinbeck, political activist, communist activist. And Geer was going to New York to star in Tobacco Road, a Broadway version of Tobacco Road, and suggested to Woody, “Look, you know, why don’t you come out? Why don’t you come out to New York? There’s a lot going on there.” And so Woody deposited his long-suffering family in Texas, back in Pampa, and hitchhiked to New York in 1940. And that really was the only—I suppose the only permament home that he had for the rest of his life would have been New York City.
Amy Goodman: And talk about what being in New York meant for him. Who did he meet? What was he singing?
Will Kaufman: Well, he was singing some interesting songs, first of all—writing some interesting songs, because as he was hitchhiking north and east our of Texas in that bitter cold new year of 1940, all he’s hearing on the radio is Kate Smith singing Irving Berlin’s “God Bless America.” And that’s—that was the big hit of the year. And Woody hated that song.

Through the night with a light from above.
Will Kaufman: Now, I mean, there’s two ways you can look at that song. You can look at “God Bless America,” written by Irving Berlin, all right—it’s the fearful prayer, almost, of a European Jewish immigrant to the United States who’s nervously watching the rise of fascism in Europe and praying that it won’t happen over here. He actually wrote it back in 1917 and put it away. But, you know, looking at Hitler across the sea, he’s maybe thinking it’s time for that song to be resurrected. So that’s a charitable way of looking at it. It’s not bombastic, it’s not patriotic; it’s fearful, and it’s hopeful.
That’s not the way Woody saw it. Woody saw it as a strident, jingoistic, complacent, tub-thumping anthem to American greatness. And now, he had just come from the Dust Bowl. He’d just come from the barbed-wire gates of California’s Eden there. He’d seen the Hoovervilles. He’d seen the bread lines. He’d seen labor activists getting their head busted. And so, he’s thinking, what—God bless—what America, you know, is Kate Smith singing of? So he sits down and writes a song in response to Irving Berlin, and he calls it “God Blessed America for Me.” And later on, he decides to come back to that song and change the title, change the verses, change the refrain, and it becomes “This Land Was Made for You and Me.” And then he puts it away. So, that’s one of the songs he’s writing in 1940.

Amy Goodman: Let’s talk about “This Land Is Your Land” —
Will Kaufman: OK.
Amy Goodman: —and what it became, in fact, for President Obama’s inauguration.
Will Kaufman: Yeah. I think probably the biggest audience, single audience, ever to hear that song was the inaugural concert for Barack Obama, where Bruce Springsteen and Pete Seeger sang the restored version. Because, you see, “This Land Is Your Land” has an interesting history. It starts off as “God Blessed America for Me.” And it contains a couple of killer anti-capitalist verses that I don’t remember singing in school, you know? And three of those verses were the ones that—I mean, one verse, Woody recorded one verse, I believe, in an unreleased version, about excoriating private property. But there’s other verses in there. And, you know, that’s what Pete—Pete said, you know, “I’ll sing this song, as long as I can sing the whole thing,” and as I recorded it earlier, so you can hear the progression of that song from the angry and bitter satire that it originally was to the unofficial national anthem that it became.
Amy Goodman: Did Springsteen and Seeger sing the whole song?
Will Kaufman: They did. They did. They sang the whole thing, and they sang it right into the face of American power, right into—they had to sing it to the president of the United States. “There was a big high wall there that tried to stop me. Sign was painted saying ‘Private Property.’ But on the other side, it didn’t say nothing. That side was made for you and me.” You know? Big audience for that one.

Amy Goodman: Pete Seeger and Bruce Springsteen singing “This Land Is Your Land” in 2009, a day before President Obama was inaugurated. This is Democracy Now!, democracynow.org, The War and Peace Report, with a Woody Guthrie special. I’m Amy Goodman. Woody Guthrie was born a hundred years ago, on July 14, 1912. We’re continuing our conversation with Will Kaufman, author of Woody Guthrie, American Radical. I asked him to talk more about Guthrie’s move east in 1940.
Will Kaufman: He gets to New York. Will Geer is putting on a—organizing a concert, a benefit concert for the John Steinbeck Agricultural Committee.
Amy Goodman: Which is what?
Will Kaufman: The Steinbeck Committee to Aid Agricultural [Organization] migrants, it was a benefit—fundraising organization that was just raising money for the migrants, for the Dust Bowl migrants, out in California. Steinbeck didn’t have anything to do with it except lending his name, his name to it.
Amy Goodman: Of course, he wrote The Grapes of Wrath.
Will Kaufman: And he wrote The Grapes of Wrath, of course, yeah, and became a friend of Woody Guthrie’s there in California. So Woody said, “Yeah, of course I’ll sign up to that.” And so, Will Geer has—for this New York concert, he has a roster of some of the top up-and-coming political folk singers there, also Alan Lomax, who’s probably one of the most important figures there. He’s the archivist of American Folk Song at the Library of Congress and also a musicologist, folk song collector, like his certainly more conservative father John Lomax was. And so, Alan Lomax also had gathered around him a number of important folk singers: young Pete Seeger, Harvard dropout, Lee Hays from the Commonwealth College, “Leadbelly” Huddie Ledbetter, Josh White, other black musicians from the Piedmont. And so, that is the concert in which—when Woody Guthrie first meets Pete Seeger. Lomax later said, “Go back to that night when Woody first met Pete, and you can date the renaissance of American folk music to that night.” You know.
Amy Goodman: Will Kaufman is author of American Radical. During an interview on Democracy Now!, the legendary folk singer Pete Seeger talked about Alan Lomax and Woody Guthrie.
Pete Seeger: Well, Alan got me started, and many others. He’s the man who told Woody Guthrie, he says, “Woody Guthrie, your mission in life is to write songs. Don’t let anything distract you. You’re like the people who wrote the ballads of Robin Hood and the ballad of Jesse James. You keep writing ballads as long as you can.” And Woody took it to heart. He wasn’t a good husband. He was always running off, but he wrote songs, as you know.
Amy Goodman: Do you remember when you first met Woody Guthrie?
Pete Seeger: Oh, yeah, I’ll never forget it. It was a benefit concert for California agricultural workers on Broadway at midnight. Burl Ives was there, the Golden Gate Quartet, Josh White, Leadbelly, Margo Mayo Square Dance Group, with my wife dancing in it. I sang one song very amateurishly and retired in confusion to a smattering of polite applause.
But Woody took over and for 20 minutes entranced everybody, not just with singing, but storytelling. “I come from Oklahoma, you know? It’s a rich state. You want some oil? Go down in the ground. Get you some hole. Get you more oil. If you want lead, we got lead in Oklahoma. Go down a hole and get you some lead. If you want coal, we got coal in Oklahoma. Go down a hole, get you some coal. If you want food, clothes or groceries, just go in the hole and stay there.” Then he’d sing a song.
Amy Goodman: In 1940, Woody Guthrie appeared on a New York radio program featuring the folk singer Leadbelly.
Radio Announcer: Good afternoon. Your municipal station presents another in the series, “Folks Songs of America,” featuring that great Negro folk singer of Louisiana, Huddie Ledbetter, better known to you as Leadbelly. And Leadbelly has as his guest today the dustiest Dust Bowler of them all, Woody Guthrie of Oklahoma.
Woody Guthrie: Well, I think now we’re going to sing you one. Here’s a song here that has to do with a book and a motion picture that come out here a while back by the name of The Grapes of Wrath, wrote down by a man, John Steinbeck, who threw the pack on his back and went right out amongst the people to see just what is going on in the United States. And it just so happened that he hit a jackpot, because he knew what—where he was going and knew what he was writing about. So, I didn’t read the book, but then I seen the picture three times. And I come home, and I sat down. I wrote up a little piece about it. The name of this is “The Ballad of Tom Joad.”

It was there he found him a truck driving man

Amy Goodman: Woody Guthrie performing on the radio in 1940. That same year, he formed the Almanac Singers with Pete Seeger and others. I asked Will Kaufman, author of Woody Guthrie, American Radical, to talk about the significance of the group.
Will Kaufman: The Almanac Singers were really spearheaded by Pete Seeger and Millard Lampell and Lee Hays, and it had various personnel in this band. They were a—really wanted to form, I guess, what would have been the first self-consciously proletarian, progressive music group in America, group of singers. The idea was using song as a means of championing the union movement and the anti-intervention movement, until of course the war starts, and then they do their flip-flop and go from being anti-interventionists into war champions. They didn’t last very long. They’re dissolved, they’re broken up by about 1942. But they wrote quite a few songs which were sort of the prototype for many of the political folk groups that followed, including the Weavers, which in a sense grows out of the Almanac Singers, as some of the same people who were in that group become the Weavers, as well.
Amy Goodman: Paul Robeson—when did Woody Guthrie meet Paul Robeson, the famous singer, actor, dogged by the U.S. government, by the FBI? They took back his passport.
Will Kaufman: Yeah. He would have—I guess it would have been around in the late ’40s, when he actually met Robeson, because both of them were on the board of People’s Songs, which was an organization started by Pete Seeger as a means, again, of energizing the union movement through song. And he admired Paul Robeson very much. I don’t believe he ever sang with them. I saw one letter in which he mentions having met him. But he certainly supported him. And he was there, of course, during these—the Peekskill Riots of 1949.
Amy Goodman: Well, talk about the Peekskill Riots. Exactly what happened?
Will Kaufman: OK, 1949, August, late August, early September of 1949, the Civil Rights Congress, through People’s Songs, got Paul Robeson to agree to sing a benefit concert at the golfing grounds up in—or the Lakeland picnic area up in Peekskill, Westchester County. And before Robeson even got to the grounds, he never—in fact, he never even made it to the grounds, because for the whole previous week, the Peekskill Evening Star and other local newspapers and the Ku Klux Klan and other right-wing organizations were firing up the populists to prevent Robeson and to prevent his followers from coming to Peekskill. Robeson—you know, it was all this Robeson, you know, Jew-loving commie kind of stuff like that, because Robeson had declared—his crime was declaring, in the midst of the Cold War, that no African American would voluntarily go to war with the Soviet Union. He’d been to the Soviet Union. He said he was treated with more respect there than he was ever treated in the United States. And for that heresy, he was met with a burning cross on the hills above Peekskill, which, you know, kind of proved his point. And so, he never made it to the grounds there, but the concertgoers did. They were on the grounds there, and they were met by masked gangs of men and women and teenagers hurling rocks and abuse and beating them up with, you know, fence posts and baseball bats, and destroying the grounds and what have you.
And so, Robeson is not able to sing at Peekskill that week. But he makes a declaration. He says, “I don’t get scared when fascism comes near, like it has at Peekskill.” And he says, “I’m going to come back in a week, and I’m going to sing this concert.” And in the intervening week, they amass between 20,000 and 30,000 supporters to protect Robeson and to protect the concertgoers. And they make it into the grounds. He sings the concert. He’s buzzed by police helicopters, FBI helicopters, who try to destroy the sound. But he sings the concert. And then, there’s no violence on the grounds, but the concertgoers, as they’re leaving, they are directed deliberately into an ambush road by the Westchester County police. And all along the road there, there are gangs of teenagers and mostly young people with rocks and boulders piled high at periodic staging posts along the road all the way towards the Bronx, on bridges overhead. And they are destroying the cars. They’re throwing boulders through the windows. Glass is shattering. Hundreds of people are getting injured. Pete Seeger was there. He recalled what it was like to have his car surrounded by mobs, rocked back and forth. He’s got, even now, embedded into his chimney breast in his home up in Beacon, New York, a huge boulder which had crashed through the windscreen and almost killed his young son Danny. And this is collusion between the Westchester County police and the Ku Klux Klan and the gangs and the newspapers and what have you.
And Woody Guthrie was there. He was—I was—really been surprised that none of the major biographies about Woody have made a point of actually placing him physically at Peekskill, because he was so astounded by what he saw. He was on a bus with Lee Hays, and he said, you know, “I’ve seen some bad stuff, but this is about the worst I have ever seen.” And Lee Hays remembered that, that, you know, Woody was leading these frightened people in the bus. He was leading them in singing songs, like I’m—you know, “Takes a worried man to sing a worried song, I’m worried now but I won’t be worried long.” And he’s got really good attitude to him. You know, he’s making quite brave jokes, like, you know, “Anybody got a rock? There’s a window what needs to be opened back here.” You know, things like that. And at one point, Hays remembered that Woody pinned up a shirt against the window to stop the glass from breaking inwards, and he said, “Wouldn’t you know it? Woody pinned up a red shirt.” You know.
And Woody was so astounded by what he saw, in the space of a month he wrote like 20, 25 songs about Peekskill, that he never recorded. He put them into a—he put them into a makeshift little collection of songs called “Peekskill Songs.” He never recorded any of them, but Billy Bragg, you know, the English radical folk singer—about 20 years ago, Nora Guthrie, Woody’s daughter, who presided over the Archives, began inviting contemporary musicians in to put some of her dad’s lyrics to music. And one of these that Billy Bragg put to music didn’t end up on the double album that came out of there, Mermaid Avenue, it was called, that he did with Wilco, but they did record it. It didn’t end up in the final track, but it’s one of Woody’s great odes to Paul Robeson and what happened at Peekskill.

The Klansman leader said
Old Paul would lose his head

And around Paul’s lonesome oak

A beersoaked brassy band
Went snortling around the grounds

Westchester’s manhood
And you know they looked exactly like
Fleas on a tiger’s back
Or lost fish in the waters of
My thirty thousand.
When Paul had sung and gone
Mothers and babies going home
Cops came with guns and clubs
And they clubbed and beat ‘em
Well I would hate to be a cop
Caught with a bloody stick,
‘Cause you can’t bash the brains

Each skull you tried to crack
Has got a thousand thousand friends
All along this green grass
If you furnish the skull someday

Amy Goodman: Will Kaufman, American radical, Woody Guthrie. Woody Guthrie, American Radical is his book. Howard Fast said about Peekskill, “That’s the sound of Fascism. Not in Germany, but here in America. Remember it!” Talk more about the red-baiting at that time and how Guthrie responded to that.
Will Kaufman: Well, it was going on—the red-baiting really started with the—even before, I suppose, the election of Truman in the late ’40s. First what Woody watches, to his astonishment, is the purging of the union movement. I mean, the communist movement, the Communist Party and affiliated organizations had worked to build the American—many of the American unions and the CIO and what have you. And then they join in the purge, right after the war, of much of the left wing and much of the militancy of the labor movement. So that’s the first thing that Woody watches to his utter disillusionment. He calls himself—he says, you know, “My radical soul is so lonesome at this point.” He feels increasingly marginalized politically.
And then, of course, with the Cold War and the Truman doctrine about containing communism in Greece, Woody writes songs against Truman, writes songs expressing his astonishment that Britain and the United States could support the Greek monarchy against the workers rising there, and just sees not only the labor movement and the union movement becoming increasingly—the fangs brought out of it, drawn out of it, but then elsewhere in the wider culture, where basically McCarthyism takes hold. He sees Hanns Eisler being deported and writes a song about that, expressing his fears about what life in a McCarthy-dominated America might be like.
But then something happens. His Huntington’s disease kicks in seriously about 1952, and so he is increasingly immobilized, increasingly—his behavior is increasingly more erratic, and he finds that he has difficulty writing. He can’t speak as well. He can’t—he gets increasing bodily—a lack of coordination. And he sort of drops out—after 1952, 1953, he’s pretty—he’s sort of becoming less and less of a public figure at that point. But he is watching from the sidelines what is going on.
Pete Seeger gets called to the McCarthy committee. Well, McCarthy is gone, but the committee is certainly still there, 1955. And unlike Burl Ives, who named names to the committee, and unlike Josh White, who called himself a communist dupe or a dupe of the communists, and they—Woody excoriated them in letters. I mean, some real bitchy stuff coming out of Woody Guthrie about his former friends there. Pete Seeger decides to take the First Amendment, not the Fifth. He takes the First Amendment: “You have no right to ask me these questions, you sitting up there on that—you know, in your inquisitorial dais there.” And so, he gets slapped with a contempt of Congress citation, and he’s convicted. And he’s looking at 10 years in jail. And it’s not until 1961 that his conviction is overturned on a technicality—got nothing to do with a moral standing. In fact, ironically, the judge who overturned it was Julius Hoffman, who sent the Rosenbergs to the chair. But—
Amy Goodman: Not so far away from where he was, at Sing Sing.
Will Kaufman: Not so far, that’s right.
Amy Goodman: In Ossining, New York.
Will Kaufman: That’s right, yeah, yeah. So, Woody is certainly aware of the McCarthy committee. He knew that he was on a number of lists, because he was mentioned a few times in HUAC testimony. He was named a few times. And he’d say, you know, “Thank God I’m on these lists. I mean, there’d be something wrong if I wasn’t on McCarthy’s lists, you know?” Things like that.
Amy Goodman: You mentioned that Pete Seeger went before HUAC—
Will Kaufman: Yeah.
Amy Goodman: —the House Un-American Activities Committee. Guthrie was never called before it, but he did write an impassioned defense of Pete Seeger.
Will Kaufman: Yeah. It’s one of the most heartbreaking things to read that I came across in the Archives. It’s a letter that he wrote to Pete Seeger. And Woody’s—one of the symptoms of Huntington’s disease is that it has an incredible impact upon one’s sense of language—sentence construction, spelling, wordplay, whatever. His biographer Joe Klein calls it “linguistic anarchy.” And so, he wrote a very moving letter to Pete Seeger, basically saying, “Look, Pete, I hear you’re not going to have—you may not have to go to jail now, and that’s great. But I’ve never heard you say one evil or hateful or dangerous thing, and these people on this un-American committee are the most un-Americanistic people I’ve ever heard of.” And stuff like that. So—
Amy Goodman: Would you like to read the letter?
Will Kaufman: Yeah, when—he’s talking about Harold Leventhal, his manager, Harold Leventhal, or Hal, and Fred Hellerman of the Weavers, who came to visit Woody in hospital. And Woody wrote to Seeger. He says, “Hal and Freddy told me when they visited me here a few little weeks ago how you mite not have to go to jail for another two or more years for refusing to testify before my unnamerican committee theyre all a big bunch of the very unnnamericanistic people I ever did hear of. … To me you are just another goody martyr Pete over on my side of gods eternal love since I never did ever even hear you speakout actout nor so much as even breathe out one little breathe of hateyful hatreds of no earthy sort my crazy committee to me are always my very worst sorts of haters always anyways.”
Amy Goodman: That was the letter that Woody Guthrie wrote—
Will Kaufman: That Woody wrote to Pete Seeger.
Amy Goodman: —in defense of Pete Seeger.
Will Kaufman: Yeah.
Amy Goodman: Before HUAC, the House Un-American Activities Committee. What did Woody Guthrie himself feel were his most important achievements?
Will Kaufman: He would say, as he did say, just telling the stories of people who he encountered and putting their stories to music. He often said, “Yeah, I haven’t written an original word in my life. Everything I write down is something I heard from you out there, and I’m just telling you something you already know.” So he would say that he was—used music as a means of telling stories that otherwise would not get told, from people who would not be heard otherwise. And as far as he was concerned, that was his life’s mission.
Amy Goodman: Will Kaufman, author of Woody Guthrie, American Radical.
This is Democracy Now!, democracynow.org, The War and Peace Report. I’m Amy Goodman. As we continue our Woody Guthrie special, we turn to the British rocker and activist, Billy Bragg. In 1998 and 2000, Bragg participated in two well-known albums paying tribute to Woody Guthrie. On Mermaid Avenue Volumes 1 and 2, Billy Bragg composed music for lyrics written by Woody Guthrie and performed many of the songs alongside the album’s other main contributor, the band Wilco. I asked Billy Bragg to talk about how the project came about.
Billy Bragg: About 20 years ago, it was now, I did a show here in New York City in Central Park with Pete Seeger to celebrate Woody’s—what would have been Woody’s 80th birthday in 1992. And I met his daughter Nora, and she told me that in the Woody Guthrie archive they had lyrics of songs that Woody had written during his lifetime, which although Woody had written lyrics and music, he had actually kept the tunes in his head. He couldn’t write music notation. Now, I can’t do that. I don’t write music notation, so I understood where he was coming from. And she invited me to come and look at some of these lyrics, with a view to write some new tunes, to give them life, really.
And I was a bit skeptical about this. I think I might have said to her something like, “Surely this is Bob Dylan’s job, not mine.” But she felt that she needed someone both from a different generation and also from perhaps, you know, another culture, to be able to step back a little bit from Woody, rather than someone who grew up singing “This Land Is Your Land.” And she saw a link, and there is a link, with myself and Woody. You know, Joe Strummer of The Clash, one of my heroes, was a huge Woody Guthrie fan. In fact, he used to call himself Woody before he called himself Joe Strummer. You know, obviously Dylan, another huge influence on me, was hugely influenced by Woody. And then you get back to the little guy himself. You know, he’s the father of the political song tradition, as far as, you know, in our culture is concerned. So—
Amy Goodman: Talk a little about him, for people, young people especially.
Billy Bragg: Well—yeah, well, Woody Guthrie was born in 1912 in Okemah, Oklahoma, and during the last Great American Depression, he was writing incredible songs about the internal migrations in the United States of America, people who had to leave the Dust Bowl, the areas of the Texas Panhandle, of Oklahoma, of Arizona, and move to the fruit orchards in California. It was a huge mass migration, similar to the kind of migration—it’s kind of a east-to-west migration. Now the migration is kind of like south to north that’s going on. But that great migration is still going on. And Woody wrote these incredible songs and eventually ended up coming to New York City in 1940, lived out in Coney Island.
And although he himself never really had, during his lifetime, had a career in which he—you know, anything like mine—you know, he never did gigs, he never went on tour, he never sold T-shirts, he barely made records—the people around him, people like Pete Seeger and the Weavers, were singing his songs and popularizing his songs. And this was particularly during the 1960s in the folk revival. And people like Bob Dylan, you know, had heard legend of this guy Woody Guthrie. It was almost like perhaps he might not exist. He might just be, you know, like Johnny Appleseed. People did think, in the ’60s, did he exist? But he did exist, and he was actually—he was infirm. He was suffering from a terrible degenerative disease called Huntington’s disease, and he was in the Brooklyn Hospital here in New York. Dylan saw him before he died. He died in 1967.
But his legacy was to write the—I suppose, what you might call the founding songs of political pop, you know. And I would argue that he was the first alternative musician. He wrote his most famous song, “This Land Is Your Land,” as an alternative to the number one hit single in jukeboxes in 1940, when he was hitchhiking to New York. Every time he went and stopped in a bar, someone would put this song on the jukebox. And it was Irving Berlin’s “God Bless America.” And he hated it. It was like, how can you say that about—you know, it was still the Depression. In the 1940s, the Depression hadn’t ended in the United States of America. It was only the Second World War that we ended the Depression. And he sat down, and he wrote this song called “God Blessed America for You and Me,” and which later became “This Land Was Made for You and Me.” So, Woody was the—he was the first punk rocker, and the last Elizabethan balladeer. He was many, many things, Woody.
Amy Goodman: So talk about some of the lyrics that you found.
Billy Bragg: We—the album that we made, Mermaid Avenue, myself and Wilco in the late ’90s, we actually recorded a lot more material that has never been released. And next year, we’re hoping to release that whole full third—a whole third album, another 16-, 17-track stuff. But Woody’s original songs, the songs that he wrote back in the 1930s—you know, I mean, the one that I’m going to play for you now, which is one of his classic songs, with these images of people losing their houses to the banks, of gamblers on the stock markets making millions, when ordinary working people can’t afford to make ends meet, and of people dying for want of proper free healthcare, you know, this song could have been written anytime in the last five years, really, in the United States of America. Actually, this song is over 70 years old. It’s called “I Ain’t Got No Home in This World Anymore.”

Private First Class Kimberly Rivera — a conscientious objector and pregnant mother of four — has just been sentenced to military prison for refusing to serve in the Iraq War. Rivera was on a two-week leave in December 2006 when she decided she would not return to Iraq for a second tour of duty. She and her family fled to Canada in February 2007, living there until their deportation back to the United States last year. On Monday, a military court sentenced her to 10 months behind bars. Her fifth child is due in December. We’re joined by Mario Rivera, Kimberly’s husband and now the primary caretaker of their four young children, and by James Branum, a lawyer who represents Kimberly and dozens of other conscientious objectors.

AARON MATÉ: We turn now to the case of Private First Class Kimberly Rivera. She is a conscientious objector and a pregnant mother of four children, who has just been sentenced to military prison. Rivera first deployed to Iraq in 2006. During a two-week leave back in the U.S., she decided to refuse a second tour of duty in Iraq. In January 2007, Rivera and her family packed up their car and crossed the border into Canada. She was later charged with desertion and faced up to five years in prison if convicted. Well, on Monday she was sentenced to 14 months. Under a pretrial agreement, she will serve 10 months of that sentence.
This is Kimberly Rivera speaking late last year about her case.
AMY GOODMAN: Since their arrival to Canada in early 2007, Kimberly Rivera, her husband and two children settled in Toronto. She had two more children there and made several attempts to legally immigrate. Canada’s War Resisters Support Campaign championed the case, drawing endorsers including Nobel Peace Prize winner Desmond Tutu. But Canadian officials refused. In August, they ordered the Rivera family to leave the country or face deportation. A provincial lawmaker representing Rivera’s Toronto district, Cheri DiNovo, condemned the order.
AMY GOODMAN: That was Ontario lawmaker Cheri DiNovo speaking last August.
Kimberly Rivera turned herself in at the U.S.-Canadian border just days later. She’s now on her way to a military prison for 10 months. Her fifth child is due while she’s behind bars.
Well, we’re joined right now by her husband, by Mario Rivera. He will now become the primary caretaker for their four young children. We’re also joined by James Branum, the defense attorney who represented Kimberly during her court-martial yesterday, Monday, at Fort Carson. He’s also represented dozens of other conscientious objectors, is legal director for the Oklahoma Center for Conscience and Peace Research. They’re speaking to us from the Tim Gill Center for Public Media in Colorado Springs, home to Rocky Mountain PBS and KRCC public radio.
We welcome you both to Democracy Now! Mario, you’ve just come out of the court yesterday. Can you respond to the sentencing of your wife Kimberly to 10 months in jail for refusing to return to Iraq and go to Canada instead?
MARIO RIVERA: I think it was severely harsh, and I personally feel that the judge already made up his mind before the trial had even started. It’s just too much. The kids need her.
AARON MATÉ: Mario, tell us about the reaction of your children. How have they handled this whole ordeal? And what did they say yesterday?
MARIO RIVERA: As soon as they found out yesterday, they broke down into tears. Just the thought of being away from their mother for—sorry, for 10 more months; they’ve already been gone for eight months out of her life, so it’s difficult.
AMY GOODMAN: Mario, how old are your kids, and what are their names?
MARIO RIVERA: Christian is 11, Rebecca is eight, Katie is five, and Gabriel is two.
AMY GOODMAN: James, James Branum, you’re her attorney. When she was in Iraq, she turned to a chaplain to say she could not do this, that she could not, when she looked at Iraqi children, she said, open fire?
JAMES BRANUM: Yes, she talked to the chaplain, expressed her concerns. She said that she didn’t think she should—could pull the trigger, if asked to. And this is a critical issue, because she was a gate guard at FOB Loyalty in Baghdad. Her job was a critical—critical thing, as far as security coming on and off the base. And so, she felt that she morally could not do what she was asked to do; at the same time, she realized that she would put other soldiers in danger if she didn’t pull the trigger when the time came. She talked to a chaplain about it. The chaplain largely pushed her aside, did not give her the counsel that she really needed. And so, when she came home on leave, she took other steps. And it’s unfortunate that she did not get the legal advice and information she needed to seek status as a conscientious objector.
AMY GOODMAN: So when she—
JAMES BRANUM: That said—
AMY GOODMAN: James Branum, so when she said this to the chaplain, he didn’t say, “There’s a way you can legally do this: You could apply for a CO status”? Instead he argued with her?
JAMES BRANUM: Yes.
AMY GOODMAN: So she didn’t know the process?
JAMES BRANUM: The chaplain was very, very resolute that Kim—that she needed to stay there, she needed to fulfill her mission, instead of giving her the spiritual counsel she needed at that moment. Instead, this chaplain told her basically, “Suck it up. Continue on.” And that was—that was not the advice she needed at that moment. She needed to know her rights. She needed to know AR 600-43 gives her the right to seek status as a conscientious objector. She didn’t know that.
AARON MATÉ: James, so 10 months in prison—how does this sentence compare to sentences to other resisters? And is there an exception here, by given the fact that she’s pregnant and is due in December? How does that factor in?
JAMES BRANUM: We don’t know. The judge doesn’t really give the rationale for why he made the decision he did. We do know there have been some resistance cases that have received greater sentences. As long as 24 months has been given. But many other resisters receive little jail time or no jail time. And people that desert, generally, over 90 percent do no jail time at all. And so, we feel that Kim was singled out.
Another thing, the prosecutor at trial said that he asked the judge to give a harsh sentence to send a message to the war resisters in Canada. And we feel that was—the Canadian government, in deporting Kim, said she would not face any serious punishment because of her political and conscientious objection to war. And in reality, that’s exactly what happened. That was the prosecution’s argument, that because she spoke out against the war, she therefore should be punished.
AMY GOODMAN: Mario, you live in Colorado, is that right, with your four children?
MARIO RIVERA: No, the four children are in Texas right now. I came up here in March, originally, because that was when the trial was supposed to have been. Unfortunately, my mom fell ill, and it was pushed back until yesterday.
AMY GOODMAN: So, how will you raise the four kids alone? How are you going to do this over the next 10 months?
MARIO RIVERA: I don’t know. It’s going to be difficult. I’m just going to have to do my best and try to keep it together and keep them together and just help them be strong.
AMY GOODMAN: I want to thank you both for being with us, and Mario especially. I know this was very tough for you to come on today. Mario Rivera, Kimberly Rivera’s husband—she serves her 10-month sentence; he becomes the primary caretaker for their four young children. She will be serving that time—where? In California?
JAMES BRANUM: We believe it will be in Miramar. One other critical thing to mention is there is an ongoing campaign to have her released on clemency grounds. Information on that—
